Plain Language Summary

BikeEye is a free service for reporting bike lane obstructions. Use it responsibly, don't abuse it, and understand that we provide it as-is without guarantees. You own your content, but you give us permission to display it on the map.

1. Acceptance of Terms

By using BikeEye (the "Service"), you agree to these Terms of Service. If you don't agree, please don't use the Service. We may update these terms from time to time, and continued use constitutes acceptance of any changes.

2. Description of Service

BikeEye allows users to report bike lane obstructions, view reports on a map, and download aggregated data. The Service includes the mobile app, website, and related services.

3. User Accounts

To submit reports, you must sign in with Apple. You are responsible for maintaining the security of your account. You must be at least 13 years old to use BikeEye. By creating an account, you represent that you meet this age requirement.

4. Acceptable Use

You agree to use BikeEye only for its intended purpose. You must not:

• Submit false, misleading, or spam reports
• Upload content that is illegal, harmful, threatening, abusive, or harassing
• Attempt to access other users' accounts or private data
• Interfere with or disrupt the Service or its servers
• Use automated systems to submit reports or scrape data beyond provided exports
• Use the Service for any commercial purpose without permission

We reserve the right to suspend or terminate accounts that violate these terms.

5. Your Content

You retain ownership of photos and reports you submit ("Your Content"). By submitting content, you grant BikeEye a non-exclusive, worldwide, royalty-free license to use, display, and distribute Your Content as part of the Service.

You represent that you have the right to submit Your Content and that it does not infringe on anyone else's rights.

6. Open Data

Aggregated, anonymized report data (locations, times, obstruction types) is made publicly available for download. This data is provided under the Open Database License (ODbL). You may use this data for any purpose, including commercial purposes, provided you attribute BikeEye and share any derived databases under the same license.

7. Disclaimer of Warranties

BikeEye is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:

• The Service will be uninterrupted or error-free
• Report data is accurate, complete, or current
• The Service will meet your specific requirements

BikeEye is not a safety service. Do not rely on report data for navigation or safety decisions. Always exercise caution while cycling.

8. Limitation of Liability

To the maximum extent permitted by law, BikeEye and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.

This limitation applies regardless of the theory of liability (contract, tort, or otherwise) and even if we have been advised of the possibility of such damages.

9. Indemnification

You agree to indemnify and hold harmless BikeEye and its creators from any claims, damages, or expenses (including legal fees) arising from your use of the Service, your violation of these terms, or your violation of any third-party rights.

10. Termination

You may stop using BikeEye at any time by deleting your account. We may suspend or terminate your access to the Service at any time, for any reason, without notice. Upon termination, these terms remain in effect for any content you submitted.

11. Governing Law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Ontario, Canada.

12. Changes to Terms

We may modify these terms at any time. We will notify users of significant changes through the app or website. Continued use after changes constitutes acceptance of the updated terms.
